Work Accident Lawyers in Middletown

Guidance After an Injury on the Job

A workplace injury can affect your medical treatment, income, work restrictions, and ability to return to the job. Connecticut workers’ compensation provides a system for eligible employees to pursue medical care and disability-related benefits without having to prove that the employer caused the accident.

At David A. Zipfel & Associates, LLC, we represent injured people throughout Connecticut. Since 1978, our firm has handled more than 3,000 cases and recovered more than $10 million for wrongfully injured clients.

We can review how the injury occurred, the status of your workers’ compensation claim, your current treatment and work restrictions, and whether another person or company may also bear legal responsibility.

Call (860) 528-4567 or contact us online to discuss your injury, current treatment, work status, and potential legal options.

How Connecticut Workers’ Compensation Works

Connecticut workers’ compensation is generally a no-fault system. A qualifying employee does not ordinarily have to prove that the employer acted negligently to receive covered benefits.

Depending on the injury and medical evidence, available benefits can include necessary medical treatment, weekly payments during a period of disability, vocational rehabilitation, and benefits for qualifying permanent impairment, scarring, or disfigurement.

A claim can become disputed over issues such as:

  • Whether the injury arose from employment
  • Whether particular medical treatment is necessary
  • Whether the worker remains disabled
  • Whether the employee can return with restrictions
  • The amount of weekly benefits
  • Whether benefits should begin, continue, decrease, or stop

When an insurer contests a claim or benefit, the dispute may proceed through the Connecticut Workers’ Compensation Commission rather than through an ordinary personal injury trial.

Filing a Workers’ Compensation Claim

Reporting an injury to an employer and formally preserving a workers’ compensation claim are not necessarily the same thing.

Connecticut workers should generally file Form 30C, Notice of Claim for Compensation, with the employer and the appropriate Workers’ Compensation Commission office as soon as possible.

For an accidental injury, Connecticut General Statutes §31-294c generally requires written notice of claim within one year of the accident. Occupational-disease claims use a different statutory period tied to the first manifestation of a symptom.

The correct timing can depend on how the condition developed, so an employee with repetitive trauma, an occupational illness, or uncertainty about the injury date should not assume that the same deadline applies in every situation.

Middletown Workers’ Compensation Proceedings

Middletown falls within the jurisdiction of the Connecticut Workers’ Compensation Commission’s 8th District Office.

The Commission uses administrative law judges to resolve workers’ compensation disputes through procedures that can include mediation, informal hearings, pre-formal hearings, and formal hearings.

A disputed claim may involve medical records, wage information, employment records, opinions concerning work capacity, or evidence connecting the injury to job duties.

We prepare the record around the issues actually in dispute rather than treating every workers’ compensation claim as if it follows the same path.

Can You Have a Third-Party Claim Too?

Workers’ compensation and a personal injury claim can sometimes arise from the same accident.

Workers’ compensation generally addresses the relationship between the injured employee and a covered employer. Connecticut General Statutes §31-293 can preserve a separate claim against another person or business that is legally responsible for causing the work-related injury.

Depending on the facts, a third-party claim may involve:

  • Another contractor or subcontractor
  • A property owner responsible for an unsafe condition
  • An equipment owner or rental company whose negligence contributed to the accident
  • A manufacturer or seller connected to a defective product

For example, workers injured on active jobsites may have issues addressed by our Middletown construction accident attorneys.

An injury caused by dangerous property conditions may involve premises liability, while defective machinery or safety equipment can raise separate product liability issues.

No third party is automatically liable simply because it was present or connected to the worksite. A separate personal injury claim requires evidence establishing legal responsibility and causation.

Workers’ Compensation and Third-Party Recoveries Interact

A workers’ compensation case and a third-party lawsuit should not be treated as unrelated sources of recovery.

Connecticut law gives employers and workers’ compensation carriers certain intervention, lien, and reimbursement rights when benefits have been paid and an injured employee later recovers against a responsible third party.

That interaction can affect settlement decisions and the amount ultimately available to the injured worker.

Reviewing both claims together can help identify applicable deadlines, responsible parties, insurance coverage, and reimbursement issues before one case affects the other.

Evidence to Preserve After a Work Injury

The evidence needed depends on how the injury occurred and what issues the employer, insurer, or third party disputes.

Useful records may include:

  • Accident and incident reports
  • Photographs or video of the location or equipment involved
  • Witness names and contact information
  • Medical records and work-status notes
  • Written job restrictions
  • Wage information
  • Messages with supervisors or insurers
  • Maintenance or equipment records when relevant
  • Documents identifying other contractors or companies at the site

Continue following appropriate medical treatment and documented restrictions. Changes in symptoms, work capacity, or medical recommendations should also be reflected accurately in the treatment record.

Different Claims Can Have Different Deadlines

A worker with both a workers’ compensation claim and a third-party personal injury claim may face more than one filing period.

For an accidental workers’ compensation injury, Form 30C generally must be filed within one year under Connecticut General Statutes §31-294c.

A negligence lawsuit against a third party may instead fall under Connecticut General Statutes §52-584, which generally uses a two-year period from when the injury was sustained or discovered, or reasonably should have been discovered, together with a three-year outer limit measured from the defendant’s act or omission.

Other claims and circumstances can involve different rules.

The safest approach is to identify each potential claim and deadline from the facts rather than assume that a workers’ compensation filing protects a separate lawsuit.
